General Terms and Conditions (Terms) for Accommodation

§ 1 Scope

These Terms apply to the rental of the accommodation operated by Host DUK42a (Markus Walschburger). Full provider details are available in the Imprint. They apply to direct bookings as well as to bookings made via intermediary platforms (Airbnb, Booking.com, etc.), unless the platform's own terms take precedence. Any deviating agreements require text form (e-mail is sufficient).

§ 2 Conclusion of Contract and Payment

The contract is concluded upon receipt of the booking confirmation. The agreed price is to be paid using the method and within the deadline selected at the time of booking. If payment fails to be made, the Host may, after granting a reasonable grace period, withdraw from the contract.

§ 3 Arrival and Departure

Check-in from 3:00 p.m., check-out by 11:00 a.m. Different times are only possible by prior agreement. The following surcharges may apply: Early check-in € 30, late check-out € 50. Access is generally contactless via a code; the access details are sent before arrival.

§ 4 Registration Obligation (foreign guests only)

Foreign guests are required under §§ 29, 30 of the German Federal Registration Act (BMG) to complete a registration form upon arrival and to present a valid passport or national ID card. The data collected includes name, date of birth, nationality, home address, type and number of the identification document, and issuing authority. This obligation also applies to foreign co-travellers of a German main guest. For German citizens, the special registration requirement in accommodation facilities has been abolished as of 1 January 2025 (Fourth Bureaucracy Relief Act – BEG IV). Registration is handled via the Guesty Guest App.

§ 5 City Tax (Übernachtungsteuer) – including Business Travellers, Tradespeople & Fitters

In accordance with the City of Karlsruhe regulations, a City Tax per guest and night has been levied since 1 July 2025 (current rate: € 4.00; from 1 January 2028: € 4.50). The City Tax applies to all paid overnight stays in Karlsruhe accommodation establishments – regardless of whether the stay is private or business-related (including business trips, tradespeople, fitters, trade fair and conference guests). Exemptions apply in particular to children and adolescents under 18 years of age, as well as to stays exceeding two consecutive calendar months (from the day after the cut-off date onwards).

§ 6 House Rules

The following house rules are binding: occupancy is limited to registered persons only; the maximum number of guests is strictly enforced. Quiet hours apply from 10:00 p.m. to 8:00 a.m.; parties and events are not permitted. Smoking is strictly prohibited indoors (including e-cigarettes); a cleaning fee of € 150 will be charged in case of violation. Pets are only permitted with prior written consent; any additional fee depends on the respective booking conditions. Waste must be properly disposed of upon departure. In case of loss of keys or access codes, a flat fee of € 75 will be charged; further damages remain reserved.

§ 7 Use of Wi-Fi

Use of the provided Wi-Fi is at the guest's own responsibility. In particular, the following are prohibited: file sharing and peer-to-peer activity, accessing illegal content, and sending spam or malicious software. The guest shall indemnify the Host against all third-party claims and reasonable legal costs arising from any unlawful use of the Wi-Fi access by the guest or co-travellers. In case of a justified suspicion of misuse, the Host reserves the right to suspend access. Connection and user data are stored only to the extent legally required (see Privacy Policy).

§ 8 Liability of Guests / Damages

The main guest is jointly and severally liable for all damages exceeding normal wear and tear, including damages caused by co-travellers. Damages must be reported to the Host without delay. In the event of wilful damage, a lump-sum compensation of € 200 will be charged; the guest is at liberty to prove that no damage or only a substantially lower damage was incurred. Compensation for actually higher damages remains unaffected.

§ 9 Cancellation and Withdrawal

The cancellation conditions agreed at the time of booking shall apply. For bookings via intermediary platforms, the platform's cancellation conditions are decisive. In case of a no-show, the full booking amount will be charged. Note pursuant to § 312g (2) no. 9 German Civil Code (BGB): for accommodation contracts tied to a specific date, there is no statutory right of withdrawal.

§ 10 Force Majeure

In the event of force majeure (e.g. natural disasters, pandemics, official orders, supply outages), both parties are released from their performance obligations. Payments already made will be refunded on a pro-rata basis, provided that no expenses have been incurred by the Host.

§ 11 Liability of the Host

The Host is fully liable for damages resulting from injury to life, body or health, as well as for damages caused by intent or gross negligence. For other damages, the Host is liable only in the event of breach of essential contractual duties (cardinal duties) and limited to the typical foreseeable damage.

§ 12 Data Protection

Personal data are processed exclusively for the performance of the contract and to fulfil legal obligations (Federal Registration Act, tax law). Details are provided in the separate Privacy Policy.

§ 13 Dispute Resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. The Host is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Provisions

The law of the Federal Republic of Germany applies, with the exception of the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions remain unaffected. Place of performance is the location of the accommodation. The contract language is German; translations serve information purposes only – the German version shall prevail.
